WASHINGTON (Reuters) - The U.S. diplomat charged with closing the prison at Guantanamo Bay, Cuba, is taking up a new post and will not be replaced, with most of his duties being turned over to the State Department's top lawyer, U.S. officials said on Tuesday.
The fact that Ambassador Dan Fried will not be replaced may raise questions about the Obama administration's plan to close the prison, though the officials denied any erosion in their commitment to shutter the detention center.
There are now 166 prisoners held at the Guantanamo Bay U.S. Naval Base in Cuba in a detention center set up after the September 11, 2001, attacks to hold people captured in counterterrorism operations overseas.
On taking office in 2009, President Barack Obama ordered the prison closed within a year but that initiative failed in part because of security concerns among Americans and opposition from Congress, which passed laws making it harder to transfer prisoners out.
Fried is becoming the State Department's sanctions coordinator, where much of his work will focus on efforts to use economic penalties in conjunction with diplomacy to try to force Iran to address questions about its nuclear program.
The officials, who spoke on condition of anonymity, said Fried's work on transferring Guantanamo Bay prisoners would now be handled by the office of the State Department legal adviser.
"The placement of the Guantanamo portfolio in the Office of the Legal Adviser does not signal a diminution of the administration's commitment to close Guantanamo," said a senior State Department official.
"The Administration has made clear that closing the Guantanamo Bay detention facility is in the interest of our national security and remains committed to the responsible and safe transfer of the remaining detainees," the official added.
He stressed the administration's "opposition to congressional restrictions that impede our ability to implement these transfers."
During Fried's tenure, 71 Guantanamo Bay detainees have been transferred to various destinations, including 40 who were sent to countries rather than to their own nations, the officials said.
Fried's unrelated work on closing Camp Ashraf in Iraq, used by members of the Mujahadin-e Khalq Iranian dissident group, will be handled by the State Department's bureau of Near Eastern Affairs.

Unlike Sandy, the nameless North Atlantic superstorm poses no threat to land. But it does highlight the power such storms can attain.
It's forecast to develop winds of up to 98 miles an hour, while the air pressure at its center ? expected to reach a low between 920 to 930 millibars ? would rival that of a category 4 hurricane, according to forecasters at the National Oceanic and Atmospheric Administration's Ocean Prediction Center in College Park, Md.
The system is the same storm "that gave us some snow a couple of days ago in DC," says Robert Banks, a forecaster at the Ocean Prediction Center. The storm intensified as the cold air moved out over relatively warm North Atlantic water, which is feeding energy into the system.
In addition, the system is merging with two other upper-level troughs ? providing the storm with yet more punch.
It's not clear how this storm will fare in the record books, Mr. Banks says. But over at the Weather Underground's web site, data gathered by British weather historian Stephen Burt shows five other storms between 1824 and 1986 with central pressures ranging from 920.2 to 925.6 millibars.
An extra-tropical superstorm in January 1993 holds the record for low pressure ? 913 millibars ? for North Atlantic winter storms in an event that destroyed an oil tanker after it ran aground at the Shetland Islands. The tanker, the MV Braer, was carrying 85,000 tons of crude oil.

Marketing your services
Don?t put all your eggs in one basket. Develop a diverse client base in terms of industries you sell to and the size of client organizations you target. For example, during the 1980s the bottom dropped out of the oil business for several years. As a result many chemical companies and consultancies, large and small, saw their sales to oilfield service companies decline substantially. Having a diverse client base would have helped lessen the impact of this sort of situation. Having contingency plans to implement would allow you to quickly compensate for the loss of major customers.
I derive much of my income from my freelance technical writing. During the recent recession I saw my income from sales to both companies and magazines drop substantially. To compensate for this I expanded my sales to government agencies and the nonprofit sector. Luckily I did not have to start from ground zero since I already had some sales to these sectors before the economic slump hit in 2008. I also monitored my sales closely and was able to take timely action to expand my client base because I saw my sales to certain sectors begin to decline in the fourth quarter of 2007.
During the 1980s when my technical writing sales to the oil industry slumped, I was able to compensate by recruiting new clients in Europe and marketing to pharmaceutical industry trade publications. However, because most European countries have been harder hit by the recent recession than the U.S., these strategies did not work for me this time around. Instead I increased my marketing to units of the federal government.
Managing money issues
When you are selling services, it is often difficult to decide what to charge. There are several strategies you can adopt. First, you can learn what your competitors are charging for the same or very similar services and adopt a similar price structure. Alternatively you could take the approach of offering a premium service and charging a higher price. This is the approach I usually take and it often works even in competitive bidding situations if you clearly explain what you are selling and why your service is more cost effective at a higher price than competitors. For example, I occasionally charge 25% to 33% more than my competitors in competitive bidding processes and still win the work. Of course, this approach means that I must provide the added value that I promise.
Sometimes it is difficult to obtain a fair price for your service. For instance, in 2011 a major oil company saw freelance writing projects being offered at $25 per hour on Craig?s List. Neglecting the greater difficulty of technical writing, they offered technical writing projects at this fee. I and some other technical writers turned down the work when it was offered at this low hourly rate because it was substantially lower than the going rate for this kind of writing. The oil firm hired people with limited or no technical backgrounds to work on the projects. They got unsatisfactory documents (chapters in a training manual for example) as a result. I don?t know how this situation was eventually resolved. However, I do know they approached another technical writer and me to whom they offered the original low fees to edit and improve these poorly written documents.
The sharp drop in income during the recent recession led some experienced consultants and technical writers desperate for work to reduce their fees. However, now that the U.S. economy is growing again, albeit slowly, these chemists are finding many of their clients are refusing to pay their pre-recession fee levels. Thus they face the unpleasant choice of losing clients or working for lower fees.
Meeting clients? specifications
When designing projects for clients, it is essential to agree upon the specifications of the project, project budget, the timetable for completion of various parts of the project, schedule of payments and reporting requirements. Having project management skills is often essential in managing projects to the satisfaction of the client as well as yourself.
It is worth spending time up front clearly defining the client?s specifications and agreeing on how you will meet them. These are the biggest factors in determining whether the client will be satisfied with your work and willing to assign you additional projects.
Minimizing scope creep
Scope creep results when new features are added to a project?s scope after work has started. Scope creep is usually caused by inadequate planning at the beginning of the project. Often each change request is small and the entrepreneur accepts them to keep the client happy. However, a point often is reached when the changes become numerous enough that the project requires much more work than originally agreed upon. The additional work can delay project completion and cause the project to go over budget.
Meeting deadlines
To achieve commercial success it is often essential to complete the project on schedule. To help assure this, project managers often adopt project milestones and dates for their completion. Milestones are intermediate goals that clearly indicate progress in achieving final project goals and completing the project. They are also useful in monitoring project spending relative to achieving project goals.
Following these 5Ms helps increase the overall success of your business while increasing customer satisfaction and increasing the chances of obtaining repeat business.

Let me acknowledge ? sincerely ? that I love wheelchair basketball. I would vote for candidates to public office who would provide funding for ?inclusive athletics? and would be proud if my sons? schools offered such programs to their special-needs students.
Yet it boggles my mind that the Obama Administration, without an ounce of public debate or deliberation, without an iota of Congressional authorization or approval, could declare by fiat that public schools nationwide must provide such programs or risk their federal education funding. Talk about executive overreach! Talk about a regulatory rampage! Talk about an enormous unfunded mandate!
At issue is the 1973 Rehabilitation Act?s insistence that public schools not discriminate against students with disabilities. Longstanding regulations clarify that this requirement applies to extracurricular activities, too. A 2010 Government Accountability Office report highlighted confusion in the field about what exactly was expected of schools, particularly with regards to participation in sports, and urged the Department of Education to clarify the issue by publishing new ?guidance.?
This is what?s happened today. And some of that guidance (still not on the Department?s website, as far as I can tell) is pragmatic enough. Schools must allow ?reasonable? accommodations for student-athletes with disabilities, such as providing a ?visual cue? to sprinters with hearing impairments. I?ve got no argument there.
But the Department?s Office of Civil Rights went much further, finding a ?right? to separate sports programs in cases when accommodations are impractical. In other words, a right to wheelchair basketball. Read it yourself:
Students with disabilities who cannot participate in the school district?s existing extracurricular athletics program ? even with reasonable modifications or aids and services ? should still have an equal opportunity to receive the benefits of extracurricular athletics. When the interests and abilities of some students with disabilities cannot be as fully and effectively met by the school district?s existing extracurricular athletic program, the school district should create additional opportunities for those students with disabilities.
In those circumstances, a school district should offer students with disabilities opportunities for athletic activities that are separate or different from those offered to students without disabilities. These athletic opportunities provided by school districts should be supported equally, as with a school district?s other athletic activities.
Note especially the phrase ?should be supported equally.? What might that mean? Must districts spend the same amounts on their disability-sports programs as on their regular sports program? Is it enough to offer wheelchair basketball, or must schools also offer wheelchair tennis, wheelchair volleyball, and wheelchair track and field, too? How would this be applied to other extra-curricular activities? Must schools offer special chess programs for students with cognitive disabilities? Special debate programs for students with speech challenges?
And, of course, how are districts supposed to pay for all of this?
Surely there are good answers to these and other questions and workable solutions that can be found. Trade-offs can be considered, priorities identified, compromises made. But the right place to hash out these concerns is in school-board meetings, not in Washington. And if the federal government insists on creating a ?right? to these types of programs, the correct place to do that is on the floor of the House and Senate ? not in the bowels of the U.S. Department of Education.
The step that federal officials are taking today will have wide-ranging consequences for decades to come. It potentially puts school districts on the hook for billions of dollars in new spending. At the very least, the changes should be subject to the regular regulatory process, which allows for public input, demands an accounting of potential costs, and gives all sides to voice their concerns. A better solution is to let legislators take up this question ? and appropriate funds if they decide that wheelchair basketball and the like is a key priority.
The American people are a compassionate lot. I have no doubt that they will support the notion that kids with disabilities should get to play sports, too. But let?s put it to their elected representatives to decide how it might work and how far a federal mandate should go, not the faceless bureaucrats in the Office of Civil Rights.

North Korea cites a U.S. military threat in the region as a key reason behind its drive to build nuclear weapons. The two countries fought on opposite sides of the Korean War, which ended after three years in 1953 with an armistice, not a peace treaty. The U.S.-led U.N. Command mans the Demilitarized Zone dividing the two Koreas, and Washington stations more than 28,000 troops in South Korea to protect its ally.
North Korea is estimated to have enough weaponized plutonium for four to eight bombs, according to American nuclear scientist Siegfried Hecker, who visited the country's nuclear complex northwest of Pyongyang in November 2010.
However, it is not known whether North Korean scientists have found a way to build nuclear warheads small enough to mount on a long-range missile.
Experts say regular tests are needed to perfect the technique, and another atomic test could take the country closer to its goal of building a warhead that can be mounted on a missile designed to strike the United States. North Korea has carried out two nuclear tests, in 2006 and 2009.
South Korean defense officials say North Korea is technically ready to conduct a nuclear test in a matter of days.
Satellite photos taken Wednesday show that over the past month, roads have been kept clear of snow and that North Koreans may have been sealing the tunnel into a mountainside where a nuclear device would be detonated.

The president of a now-defunct Mercer County, N.J., construction company was sentenced to eight years in state prison for stealing more than $450,000, according to Attorney General Jeffrey S. Chiesa.

CAIRO/ISMAILIA, Egypt (Reuters) - Seven people were shot dead in the Egyptian city of Suez during nationwide protests against President Mohamed Mursi on Friday, underlining the country's deep divisions on the second anniversary of the uprising that toppled Hosni Mubarak.
One of the dead was a policeman, medics said. Another 456 people were injured across Egypt, officials said, in unrest fuelled by anger at Mursi and his Islamist allies over what the protesters see as their betrayal of the revolution.
Mursi said the state would not hesitate in "pursuing the criminals and delivering them to justice". In a statement, he also called on Egyptians to respect the principles of the revolution by expressing their views peacefully.
The January 25 anniversary laid bare the divide between the Islamists and their secular rivals.
The schism is hindering the efforts of Mursi, elected in June, to revive an economy in crisis and reverse a plunge in Egypt's currency by enticing back investors and tourists.
Inspired by the popular uprising in Tunisia, Egypt's revolution spurred further revolts across the Arab world. But the sense of common purpose that united Egyptians two years ago has given way to internal strife that already triggered bloody street battles last month.
Thousands of opponents of Mursi massed in Cairo's Tahrir Square - the cradle of the revolt against Mubarak - to rekindle the demands of a revolution they say has been hijacked by the Muslim Brotherhood, the group from which Mursi emerged.
In Suez, the military deployed armored vehicles to guard state buildings, witnesses and security sources said, as symbols of government were targeted across the country.
Street battles erupted in cities including Cairo, Alexandria, Suez and Port Said. Arsonists attacked at least two state-owned buildings. An office used by the Muslim Brotherhood's political party was also torched.
"Our revolution is continuing. We reject the domination of any party over this state. We say no to the Brotherhood state," Hamdeen Sabahy, a popular leftist leader, told Reuters.
The Brotherhood decided against mobilizing for the anniversary, wary of the scope for more conflict after December's violence, stoked by Mursi's decision to fast-track an Islamist-tinged constitution rejected by his opponents.
The Brotherhood denies accusations that it is seeking to dominate Egypt, labeling them a smear campaign by its rivals.
DEATH IN SUEZ
There were conflicting accounts of the lethal shooting in Suez. Some witnesses said security forces had opened fire in response to gunfire from masked men.
News of the deaths capped a day of violence that started in the early hours. Before dawn in Cairo, police battled protesters who threw petrol bombs and firecrackers as they approached a wall blocking access to government buildings near Tahrir Square.
Clouds of teargas filled the air. At one point, riot police used one of the incendiaries thrown at them to set ablaze at least two tents erected by youths, a Reuters witness said.
Skirmishes between stone-throwing youths and the police continued in streets around the square into the day. Ambulances ferried away a steady stream of casualties.
Protesters echoed the chants of 2011's historic 18-day uprising. "The people want to bring down the regime," they chanted. "Leave! Leave! Leave!" chanted others as they marched towards the square.
"We are not here to celebrate but to force those in power to submit to the will of the people. Egypt now must never be like Egypt during Mubarak's rule," said Mohamed Fahmy, an activist.
There were similar scenes in Suez and Alexandria, where protesters and riot police clashed near local government offices. Black smoke billowed from tires set ablaze by youths.
In Cairo, police fired teargas to disperse a few dozen protesters trying to remove barbed-wire barriers protecting the presidential palace, witnesses said. A few masked men got as far as the gates before they were beaten back.
Teargas was also fired at protesters who tried to remove metal barriers outside the state television building.
Outside Cairo, protesters broke into the offices of provincial governors in Ismailia and Kafr el-Sheikh in the Nile Delta. A local government building was torched in the Nile Delta city of al-Mahalla al-Kubra.
BADIE CALLS FOR 'PRACTICAL, SERIOUS COMPETITION'
With an eye on parliamentary elections likely to begin in April, the Brotherhood marked the anniversary with a charity drive across the nation. It plans to deliver medical aid to one million people and distribute affordable basic foodstuffs.
Writing in Al-Ahram, Egypt's flagship state-run daily, Brotherhood leader Mohamed Badie said the country was in need of "practical, serious competition" to reform the corrupt state left by the Mubarak era.
"The differences of opinion and vision that Egypt is passing through is a characteristic at the core of transitions from dictatorship to democracy, and clearly expresses the variety of Egyptian culture," he wrote.
Mursi's opponents say he and his group are seeking to dominate the post-Mubarak order. They accuse him of showing some of the autocratic impulses of the deposed leader by, for example, driving through the new constitution last month.
"I am taking part in today's marches to reject the warped constitution, the 'Brotherhoodisation' of the state, the attack on the rule of law, and the disregard of the president and his government for the demands for social justice," Amr Hamzawy, a prominent liberal politician, wrote on his Twitter feed.
The Brotherhood says its rivals are failing to respect the rules of the new democracy that put the Islamists in the driving seat via free elections.
Six months into office, Mursi is also being held responsible for an economic crisis caused by two years of turmoil. The Egyptian pound has sunk to record lows against the dollar.
The parties that called for Friday's protests list demands including a complete overhaul of the constitution.
Critics say the constitution, which was approved in a referendum, offers inadequate protection for human rights, grants the president too many privileges and fails to curb the power of a military establishment supreme in the Mubarak era.
Mursi's supporters say enacting the constitution quickly was crucial to restoring stability needed for economic recovery.

With more than $1 billion to gain annually, suppliers say the largest retailers and their third party audit firms have stepped up the bounty hunt in the form of post payment and cost-recovery audits.
That is money sought out by firms like Connolly, PRGX and Apex Analytix who work as third party auditors on behalf of the largest retailers, including Wal-Mart and Best Buy. These firms scour the payment records between retailers and their suppliers looking for pricing errors, freight foul-ups and other opportunities for lost revenue.
Boyd Evert and his team at Harvest Revenue Group in Bentonville are standing in the opposite corner on behalf of suppliers helping them handle and prevent future audit claims that take away from their productivity and further shrink their margins.
Some suppliers who were averaging 8 to 10 claims a month, say they have recently been inundated with around 100 claims some months as the tenacity has been elevated from third party auditors working on behalf of multiple retailers, according to Evert.
Evert said Harvest?s top line revenue grew 300% in 2012, the firm?s second year of business, because suppliers are seeing record claims. He and the half dozen or so auditors at his ?watchdog? firm each spent time on the flip side of the business working for third party auditors before launching Harvest Revenue Group in March 2010.
Rob Farinholt, business development director with CaseStack, says he refers suppliers facing audit claims to Harvest. He said retailers have three levels of scrutiny ? multiple auditors, internal and third party ? combing through past payment records looking for possible claims to collect on a year round basis.
?The suppliers need an ally when it comes to refuting claims and helping them find lost revenue on their side of the transaction,? Farinholt said.
Evert said that is exactly why he established Harvest nearly three years ago. He said didn?t know of any firms working on behalf of the suppliers getting hit with claims.
THE HUNT
Evert describes an atmosphere of aggressive bounty hunting that has escalated as the economy tightened and retailers discovered profit centers built into their own payment systems every time a claim against a supplier is written and won.
?Third party auditors also work on a contingency basis. They don?t get paid unless they recover money for the retailer, so they are very creative in finding new claims to file,? Evert said.
He said the margin of recovery is roughly one-tenth to two-tenths of 1% of total sales. For a company like Wal-Mart that?s a potential of $500 million annually in audit recoveries. Best Buy in comparison has the potential for $57 million annually for audit recoveries, resulting from errors in pricing, promotions and shipping.
Across the entire retail channel, Evert says there is $1 billion to $2 billion in errors that suppliers and retailers are trying to recover for themselves with the help of third party auditors and a counter effort from suppliers using companies like the Harvest Revenue Group.
Evert said some suppliers in recent years have budgeted in the cost of recovery audits when setting their prices with retailers, in essence passing along those charges to the consumer in the end.??He doesn?t expect retailers to rein in the bounty hunters simply because there is no incentive for then do to so. In fact Evert said the largest companies like Wal-Mart often use multiple third party auditing firms which increases the intensity and competition to write more audit claims.
With an average retail margin of 10%, a retailer would need to generate sales of $10 million to net $1 million. But Evert says they can employ third party auditors to scour their payment records on a contingency basis and recover that and more with no cash outlay.
He said it?s only fitting that suppliers have someone helping them mount a suitable defense.
PLAYING DEFENSE
Harvest works with suppliers in the electronics, toy, food, small appliance and health and beauty aids sectors. Evert said suppliers with products getting heavy promotions and lots of price changes are among the most vulnerable for traditional post payment audit claims.
He said the ambiguous nature of sales negotiations between suppliers and buyers lends itself to audit vulnerability.
He gave this fictitious example of an audit claim: ?Let?s say a shampoo supplier comes to Wal-Mart with a promotional event for the first quarter, but the retailer opts out because it?s already doing another health and beauty aid promo. But Walgreen?s decides to do the promotion with that supplier. Because Walmart matches prices, it sells a large number of shampoo at the lower price. Several months later the third party auditor notices Wal-Mart sold more product at the lower price, but didn?t get the promo price from the supplier. So it files a post payment claim to recover the lost margin. Harvest would make Wal-Mart prove it agreed to the promo by producing a contract.?
Evert said audit claims often hit suppliers at inopportune times, and forces them to look backward, taking their focus of future productivity. There is roughly a two-year window for claims to be filed, which can seem like ages in the fast paced world of retail sales negotiations which are always forward looking, he explained.
The lead time to respond to the audits had been three to four months, but Evert said he?s seeing retailers shorten that time to between 30 and 60 days, which is putting more pressure on suppliers with the most claims.
Jami Dennis of Rapid Training Solutions, consults with suppliers of all sizes and says some retailers have begun to automatically debit the supplier accounts for these audit claims after just 30 days, which can be particularly troubling for smaller vendors with limited products and cash flow.
Dan Batson, president of NWA Retail Link User Group, said Harvest spoke at the group?s recent meeting because heightened post payment audit claims were an issue being felt by many suppliers across the entire retail chain.
Batson said the third party auditors at some firms have become very aggressive, to the point of rewriting the rules that retailers and suppliers are supposed to follow with regard to price disclosure.
?I felt so strongly about some of these audit practices that my colleagues around the industry were facing that I took a complaint to Wal-Mart?s ethics board,? Batson said. ?I felt Wal-Mart needed to know about some of the practices auditors were using to drum up claims, since those third parties do work on the retailer?s behalf.?
A Walmart spokesman said Wednesday afternoon (Jan. 23) he was investigating the matter and could not yet comment.??Batson agreed the problem is growing as competition between third party auditors escalates. He said Harvest Revenue provides a defense against claims and also works actively to educate suppliers on ways to prevent and reduce future claims.
?We are talking about billions of dollars of claims annually across the whole retail channel,? he said. ?This is a big business.?
Nate Sklaroff, director of sales at Harvest, said the firm actively holds classes and group training for suppliers wanting to learn how to reduce their risk for audit claims that result from ?creative interpretation? from poorly worded emails or documented sale contracts.
?Often times suppliers need to give more specific details in email exchanges because third party auditors scan for keywords like ?rollback? ?promo? or ?ASAP? because of the immediate time element,? Sklaroff said.
CLAIM CULTURE?
Evert says there is a claim culture among the third party auditors and they routinely share information about paid claims which sets a precedent for other retailers to follow with future audits of a similar nature.
Connolly has an office in Bentonville, but the firm did not respond to several phone and email requests for comment.

There is aggressive audit and technology innovation in an expanded range of spend categories, including media/advertising, waste removal, mobile/fixed telecommunications, utilities, freight, health care, real estate, global taxation and more.?
He touted innovations in audit techniques, which include uncovering and digitizing buy-sell agreements embedded in emails. As well as auditing the ?digital supply chain? created by mobile technology.
Yurko said in the trade newsletter found on the Apex website, ?As buyers and sellers get more creative in the ways transactions are structured, leading shared services executives are demanding that their recovery audit partners raise new questions, explore new possibilities, and innovate.?
Evert says his client training and services are designed to give suppliers the tools they need to minimize the disruption that post payment audits create.
?We not only fight claims, but we also help clients recover money they are owed in the process. Our largest score was in excess of $1 million that a retailer had to refund,? Evert said.

Jan. 22, 2013 ? Astronomers using a CSIRO radio telescope have taken the Universe's temperature, and have found that it has cooled down just the way the Big Bang theory predicts.
Using the CSIRO Australia Telescope Compact Array near Narrabri, NSW, an international team from Sweden, France, Germany and Australia has measured how warm the Universe was when it was half its current age.
"This is the most precise measurement ever made of how the Universe has cooled down during its 13.77 billion year history," said Dr Robert Braun, Chief Scientist at CSIRO Astronomy and Space Science.
Because light takes time to travel, when we look out into space we see the Universe as it was in the past -- as it was when light left the galaxies we are looking at. So to look back half-way into the Universe's history, we need to look half-way across the Universe.
How can we measure a temperature at such a great distance?
The astronomers studied gas in an unnamed galaxy 7.2 billion light-years away [a redshift of 0.89].
The only thing keeping this gas warm is the cosmic background radiation -- the glow left over from the Big Bang.
By chance, there is another powerful galaxy, a quasar (called PKS 1830-211), lying behind the unnamed galaxy.
Radio waves from this quasar come through the gas of the foreground galaxy. As they do so, the gas molecules absorb some of the energy of the radio waves. This leaves a distinctive "fingerprint" on the radio waves.
From this "fingerprint" the astronomers calculated the gas's temperature. They found it to be 5.08 Kelvin (-267.92 degrees Celsius): extremely cold, but still warmer than today's Universe, which is at 2.73 Kelvin (-270.27 degrees Celsius).
According to the Big Bang theory, the temperature of the cosmic background radiation drops smoothly as the Universe expands. "That's just what we see in our measurements. The Universe of a few billion years ago was a few degrees warmer than it is now, exactly as the Big Bang Theory predicts," said research team leader Dr Sebastien Muller of Onsala Space Observatory at Chalmers University of Technology in Sweden.

WINSTON-SALEM, North Carolina (Reuters) - A U.S. Army general facing allegations of improper conduct toward female subordinates took on his accusers on Tuesday, asking a military judge to remove the prosecutors in his case and launching a website to tell his version of what happened.
Brigadier General Jeffrey Sinclair was sent home from his post as a deputy commanding general in Afghanistan last year and faces a court-martial after being accused of inappropriate behavior involving four female subordinates and a civilian.
Much of the case revolves around an unmarried Army captain who said she and Sinclair had a three-year affair, during which she said the married 27-year Army veteran twice made her perform oral sex against her wishes.
Military prosecutors said Sinclair asked other women to send him nude photos.
The charges against Sinclair include forcible sodomy, wrongful sexual conduct and possessing alcohol and pornography while deployed.
At his arraignment at Fort Bragg in North Carolina on Tuesday, Sinclair deferred entering a plea until a judge rules on a series of motions submitted by the defense, said base spokesman Ben Abel.
Chief among them was a request to have the four prosecutors disqualified from the case, Abel said. The defense argues the Army prosecutors violated Sinclair's right to attorney-client privilege by improperly accessing confidential emails between Sinclair, his attorneys, his wife and his pastor.
The new defense website launched on Tuesday signaled Sinclair's intent to aggressively fight the charges that threaten his career, which has included combat deployments in Saudi Arabia, Iraq and Afghanistan.
On the site, www.sinclairinnocence.com, Sinclair reiterates his prior admissions that he made mistakes by having a consensual affair with one woman and exchanging inappropriate texts and emails with four others.
But he said he never forced his mistress to perform oral sex. He sought to discredit the charges against him by including links to polygraph test results, court testimony and excerpts from his main accuser's text messages and journals.
"A fair and impartial reading of the evidence will cause the case against Sinclair to unravel," the site said.

He was upfront to Ebony about this, which didn't go over too well. But while their romantic relationship ended, the two have remained friends, though not as close as they once were. Meanwhile, Ebony has moved on and is dating a woman.

Global warming 'has had a role' in making 2012 the hottest ever recorded in the lower 48 states, says a US climatologist. The average temperature was 54.3 degrees F., a full degree higher than the previous annual record.

While one degree's difference may not seem like much, the spread between the record coldest year, 1917, and the previous record warm year, 1998, is just 4.2 degrees F. With 2012's record-high reading, the gap has grown by 25 percent, according to preliminary data from the National Climatic Data Center (NCDC) in Asheville, N.C.
Last year marked the 15th consecutive year of above-normal average annual temperatures for the continental US.
Global warming "has had a role in this," says Jake Crouch, a climatologist at the NCDC, during a briefing Tuesday on the year's data. Annual average temperatures for the lower 48 states have been increasing over the past century, although he noted that it's difficult to know how much of the warming in 2012 could be pegged to human-induced climate change versus natural variability.
Regionally, the Northeast, Southwest, South, and North West Central US posted record high annual temperatures, with the North West Central US coming in at 3.9 degrees F. above the long-term average, followed by the Northeast at 3.4 degrees F. above the long-term average.
Beyond temperatures, the continental US posted the second worst year, after 1998, for severe weather, as measured by the NCDC's US Climate Extremes Index.
The most pervasive severe conditions in 2012 centered on the ongoing drought in the US. At one point in July, moderate to exceptional drought, as measured by a gauge known as the Palmer Drought Severity index, covered 61 percent of the US. Other measures still put the drought coverage at 61 percent of the country, covering most of the western two-thirds of the US.
Toward the end of last year, a dearth of water flowing into the Mississippi River threatened to shut down barge traffic along a key section between St. Louis and Cairo, Ill. But the US Army Corps of Engineers released water from the Carlyle Lake Reservoir in Illinois, which fed water into the river. The Army Corps also used explosives to pulverize rocks on the river bottom that had become threats to navigation as the water level fell. These two actions, Corps officials say, are expected to keep the Mississippi open to barge traffic through the end of January.
