    That's true for the buy and hold and index investors. But for value investors and traders, there were incredible opportunities to make profitable investments in the first half of 2009. Like everything else, people who expect to make money by doing nothing should not be surprised when that strategy fails.

    For physical bullion, IMO, this is the only kind of investing that one should be doing. This is why I compared it to the S&P 500 as it is the defacto standard for buy & hold equity investors. Certainly there are other investments that are higher risk and most likely beyond the time and ability of most people to be successful in.

Certainly there are other investments that are higher risk and most likely beyond the time and ability of most people to be successful in.

    The day will come when the bullion faithful will lose a large percentage of their investment value. While it might be true that a lot of it is past profit, similar to long term stock market investors, it will hurt a lot nonetheless. This was true for PMs and bonds in the 70s, real estate at various times and places, the tech stocks in the 1990s, and it will happen again. Every investment has its day, and all days end.

    Maybe, I'm thinking maybe not. The late 1970s were an aberration given the volatility of those first few years after Americans could legally own gold again after decades of not being able to. Even during the 1970s we are only talking about a short term bubble. Any buy and hold investor who bought early in the 70s did quite well for themselves.

    Outside of this period, gold has been used to maintain wealth for over 300 years. Far longer than any financial instrument cooked up in the last just 40 years.

    While the folks who bought gold in the early 70s did okay, those who bought in the late 70s did not. The same can be said today. Those who bought a decade ago have done okay, but those who buy today may not. And those who continue to hold, as those in the 70s did, may have to watch half or more of their value melt away after the top, and wait a very long time to get it back. I don't think this will happen soon, or I wouldn't own PMs. In fact, I think a bubble is probable and I hope to have the mental fortitude to sell into the rise and not get greedy. But I consider the eventual crash to be an inevitable outcome. The fact that gold can't go to zero is irrelevant to the investor seeking a high rate of return on their investments.

What should my intensity be?

You should be able to do 2?sets of 16 repetitions for each exercise (i.e. bicep curls) and the last few repetitions should be difficult.?If you are struggling early in a set, just give yourself a little more slack on the elastic band so that you?can do more reps with the next set. As you get stronger with time, keep readjusting by ?choking up? on?the band so that you remain at this intensity and continue to make gains.

Resistance training should be something you do along with aerobic exercise because both types of?exercise are good for your health By combining aerobic exercise and resistance training, you will?optimize your increases in strength, physical ability, weight loss, and heart health. A good plan is to go?for a fast walk or jog on one day and do resistance training on the next.

What next?

If your resistance band workout is no longer challenging enough, you can buy stronger resistance bands,?dumbbells, or even join a gym. Interactive proofs: Ten-year-old problem in theoretical computer science falls

ScienceDaily (July 30, 2012) ? Interactive proofs, which MIT researchers helped pioneer, have emerged as one of the major research topics in theoretical computer science. In the classic interactive proof, a questioner with limited computational power tries to extract reliable information from a computationally powerful but unreliable respondent. Interactive proofs are the basis of cryptographic systems now in wide use, but for computer scientists, they're just as important for the insight they provide into the complexity of computational problems.

Twenty years ago, researchers showed that if the questioner in an interactive proof is able to query multiple omniscient respondents -- which are unable to communicate with each other -- it can extract information much more efficiently than it could from a single respondent. As quantum computing became a more popular research topic, however, computer scientists began to wonder whether such multiple-respondent -- or "multiprover" -- systems would still work if the respondents were able to perform measurements on physical particles that were "entangled," meaning that their quantum properties were dependent on each other.

At the IEEE Symposium on Foundations of Computer Science in October, Thomas Vidick, a postdoc at MIT's Computer Science and Artificial Intelligence Laboratory, and Tsuyoshi Ito, a researcher at NEC Labs in Princeton, N.J., finally answer that question: Yes, there are multiprover interactive proofs that hold up against entangled respondents. That answer is good news for cryptographers, but it's bad news for quantum physicists, because it proves that there's no easy way to devise experiments that illustrate the differences between classical and quantum physical systems.

It's also something of a surprise, because when the question was first posed, it was immediately clear that some multiprover proofs were not resilient against entanglement. Vidick and Ito didn't devise the proof whose resilience they prove, but they did develop new tools for analyzing it.

In an interactive proof, a questioner asks a series of questions, each of which constrains the range of possible answers to the next question. The questioner doesn't have the power to compute valid answers itself, but it does have the power to determine whether each new answer meets the constraints imposed by the previous ones. After enough questions, the questioner will either expose a contradiction or reduce the probability that the respondent is cheating to near zero.

Multiprover proofs are so much more efficient than single-respondent proofs because none of the respondents knows the constraints imposed by the others' answers. Consequently, contradictions are much more likely if any respondent tries to cheat.

But if the respondents have access to particles that are entangled with each other -- say, electrons that were orbiting the same atom but were subsequently separated -- they can perform measurements -- of, say, the spins of select electrons -- that will enable them to coordinate their answers. That's enough to thwart some interactive proofs.

The proof that Vidick and Ito analyzed is designed to make cheating difficult by disguising the questioner's intent. To get a sense of how it works, imagine a graph that in some sense plots questions against answers, and suppose that the questioner is interested in two answers, which would be depicted on the graph as two points. Instead of asking the two questions of interest, however, the questioner asks at least three different questions. If the answers to those questions fall on a single line, then so do the answers that the questioner really cares about, which can now be calculated. If the answers don't fall on a line, then at least one of the respondents is trying to cheat.

"That's basically the idea, except that you do it in a much more high-dimensional way," Vidick says. "Instead of having two dimensions, you have 'N' dimensions, and you think of all the questions and answers as being a small, N-dimensional cube."

This type of proof turns out to be immune to quantum entanglement. But demonstrating that required Vidick and Ito to develop a new analytic framework for multiprover proofs.

According to the weird rules of quantum mechanics, until a measurement is performed on a quantum particle, the property being measured has no definite value; measuring snaps the particle into a definite state, but that state is drawn randomly from a probability distribution of possible states.

The problem is that, when particles are entangled, their probability distributions can't be treated separately: They're really part of a single big distribution. But any mathematical description of that distribution supposes a bird's-eye perspective that no respondent in a multiprover proof would have. Finding a way to do justice to both the connection between the measurements and the separation of the measurers proved enormously difficult. "It took Tsuyoshi and me about a year and a half," Vidick says. "But in fact, one could say I've been working on this since 2006. My very first paper was on exactly the same topic."

Video Conferencing Technology: Shaping the Future

The technology of video conferencing -long the domain of science fiction movies from the 1960?s onwards ? has become a daily reality in today?s world thanks to VOIP systems like Skype, Vonage and other purely web based platforms like GoToMeeting.

Video conferencing technology is improving on an annual basis and this is happening in tandem with steady improvements in bandwidth allowances, streaming video rendering and wireless connectivity. These accessory technologies are vital to the continuous growth of Video conferencing and its future developments.

At the current time, video chat is overwhelmingly being used for private communications amongst friends, family and relatives over the internet. Business use is also very widespread but usually reserved for less important situations unless an ultra-high speed broadband connection can be guaranteed.??Furthermore, as more and more mobile devices like tablets, smart phones and lap tops have VOIP and video chat applications built into them, and as more people use devices of the same technological quality, we?re seeing a constant rise in video chat sessions being done between friends and family instead of classic phone calls.

Future Uses

The above are just the currently common uses of this powerful emerging video communication technology. Many more and of a much more advanced and important nature are still waiting around the corner or just barely being developed at the moment. Already, numerous trials are being conducted in areas such as the medical field and the criminal justice system. In the case of medicine, videoconferencing is being slowly introduced as a medium through which doctors and distant specialists can give opinions, expertise and even diagnose or recommend treatment solutions strictly through video sessions. One recent experiment conducted jointly by the Boone County Jail and Columbia Municipal Court in Boone County, Missouri illustrates another use for video conferencing; the court hearings of offenders were conducted with the defendants? participation through streaming video chat instead of a personal visit. The project was soon scrapped due to video quality and transmission problems, but the fact that it was tried at all illustrates how the push in a video chat intensive future is underway.

Other future uses of video conferencing include military planning sessions, public debates amongst politicians and political conferences amongst world leaders. All of these are already being conducted, but the scale and scope will eventually increase dramatically.

It?s not just the user-end aspects of video conferencing that are going to see heavy expansion; hardware and software are changing and improving too. In the near future it will almost certainly be possible to create video display units that seamlessly and unobtrusively cover an entire wall or are meshed with a CEO?s work desk. Soon enough we may even see the advanced development of 3D conferencing technology that allows collaboration based on three-dimensional object and product designs

Numerous major tech players have clued into the enormous potential of telepresence services and products. Companies like Hewlett Packard, Cisco and Life Size Communications Inc, amongst others, have all been busy developing technology solutions for ultra HD video conferencing, full scale integration into home, office and mobile work spaces, and into creating the new data collaboration tools that will inevitably have to go along with any widespread workable use of video conferencing.

These same companies and others are also working intensely on seamlessly combining IM, voice, data exchange and clear video technologies into a single multimedia communications experience that can be used by professionals under even the most demanding reliability requirements in almost any occupation.

The Technology Issues of Video Conferencing

Most of the basic technologies for fully fleshed out video conferencing already exist. Integration of visual displays into wall, table and other office features is already at a commercial state of development while communications security through video chat on the web is also extremely robust and unlikely to be broken if applied correctly. In fact, videoconferencing security technology, with its multi-bit encryption systems for communications, is probably one of the most developed aspects of the field.

Furthermore, HD video capacity and the kinds of codecs and cameras that can handle high resolution communications displays are also already available on the market.

The single biggest problem still faced by video conferencing is bandwidth limitation. Facebook shares spook investors now. But long term?

Facebook shares reach lowest level ever as revenue growth slows and investors cash out. Analysts are more upbeat about the potential for Facebook shares.

Investors are dumping?Facebook's?stock, spooked by slowing revenue growth, the lack of a financial outlook and plans to spend more money in the coming months.

Are they right?

Only if they are thinking in the short term. Investors can expect?Facebook's?stock to be volatile for a few years. But analysts say those willing to wait will likely be rewarded ? someday.

"I view it as a tomorrow stock," says Christian Bertelsen, chief investment officer at wealth management firm Global Financial Private Capital.

"The whole thing on?Facebook?is, look, if your time horizon is hourly, weekly or even monthly, this is not the stock for you," he adds. "You need to take a much longer-term view on it."

That's about three or four years, he says.

Founded in CEO Mark Zuckerberg's Harvard dorm room in 2004,?Facebook?was a product of the PC era. Now, in the age of mobile computing, a growing number of people are accessing?Facebook?through their iPhones, Android gadgets and tablet computers. Yet?Facebook?is only now starting to figure out how to make money from its mobile audience.

"The company is going through an almost painful transition from desktop to mobile," Baird analyst Colin Sebastian says.

He calls?Facebook?"a speculative investment," but one with plenty of potential.

"With almost one billion users,?Facebook?is amassing the most comprehensive user profile database in existence," Sebastian says. This, he adds, offers a "significant opportunity" to reap a big chunk of the global advertising market, which is currently at $500 billion a year.

"Amazon comes to mind immediately," Bertelsen says.

After that company went public in 1997, at the time mainly just an online bookstore, critics were quick to cry dot-com bust, call its business a broken, and so on. Today, it is the world's biggest online retailer, selling everything from DVDs to vacuum cleaners to Web storage.

"Now they are the retailer to the world," he adds.

Amazon.com Inc.'s stock price grew to more than $200 a share, from less than $2. Of course,?Facebook?has started out much higher, at $38.

Facebook's?first earnings report since its rocky initial public offering on May 18 was the second coming that didn't quite materialize. So investors sent?Facebook's?stock to its lowest level ever on Friday. Shares fell $3.14, or nearly 12 percent, to close at $23.71 after hitting $22.28 in the morning. The previous low was $25.52, reached on June 6.

The stock dropped despite the fact that?Facebook's?second-quarter results met Wall Street's expectations, with revenue one-third higher than last year.

Given the rocky economy and investors' heightened sensitivity to a stock's value, betting on a company becomes a "show-me story" for many of them, Sebastian says. That means investors want proof rather thanFacebook's?word that it can grow its revenue and make a profit.

Nick Diaz Update: Will Return, Wants Anderson Silva

Like a passing case of the munchies, UFC welterweight contender Nick Diaz's plans to retire seem to have faded, and taking the place of that retirement is a burning desire to face UFC middleweight champ Anderson Silva.? Soon after,?it was revealed that?Diaz had tested positive for?marijuana metabolites in a post-fight urinalysis, and the subsequent year-long suspension levied upon him appeared to be the icing on the retirement cake.

Said Gracie:

For the last couple months I've watched Nick begin to frequent the gym more and more.? He's training harder now than he has for many of his fights.? It was obvious that training and fighting is in his DNA.? It is who he is.

This week we had a great talk and he made it clear to me that he is ready to get back in the cage.? Nick Diaz will return.

With interim champ Condit destined to face UFC welterweight champ Georges St. Pierre at UFC 154 in November, who is there for Diaz - an elite,?top-level fighter -?to face that's worthwhile?

As far as future opponents, Nick has stated that he would like to take fights "that matter".? Since GSP will be fighting Condit, he has to look elsewhere.? He will respectfully ask for a fight with Anderson Silva, a fighter he respects and would like to challenge.

T.Puzzle and Full Speed getting ready for a surrey bike ride when we lived near Milwaukee a few years ago.

Agreeing to disagree on a variety of issues is a cornerstone of marriage. ?There are compromises on things big and small. ?As long as both involved feel they ?win? at least some of the time, life can run fairly smoothly. ?It?s when it comes to the bigger ticket items that you both have to be completely on the same page. ?For instance, the number of kids you plan to bring into the world, if any at all for that matter, must be as close as possible. ?This number can change and shift as unforeseen circumstance arrive. ?Initially, Mad Dog and I had talked about having a big family. ?As pregnancy turned out to be one of my least favorite states of being and as Full Speed and T.Puzzle evolved into their strong-willed, glorious selves, I was quickly convinced two kids was more than enough. ?Recently, Mad Dog has been pondering the possible expansion of our brood. ?I think I could be open to this notion down the road, say when I?m about 90 years old and don?t remember who or where I am. ?I?m sorry, but my boys have worn me out. ?I believe I am only beginning to safely tread the waters of motherhood and even so, I still feel regularly challenged beyond my normal capacity.

Fortunately for me, two recent events have diminished Mad Dog?s inkling for family expansion. ?First, we had lunch with friends that we hadn?t seen in a very long time and finally met their two, extremely adorable boys. ?We met at a restaurant and I was flooded with memories as their very active nearly three year-old motored about the perimeter of the table and their nine month old baby insisted he needed to be held during the entire meal (to be honest, if I was that cute, I would insist on it, too). ?As we talked with our friends, the little conversation?we could manage over the normal hustle and bustle of raising small children, the more I appreciated my spirited boys who at least are able to independently eat a meal. ?Mad Dog appreciated this, too. ?This was a relief to me.

The second event was T.Puzzle?s recent surgery (he is doing fantastic by the way). ?In the first days post-surgery, I had given him pain meds throughout the day and night at regular intervals. ? I don?t do well with sleep deprivation (putting it mildly). ?This is why the newborn phase was and never will be, my shining moment in motherhood. ?Somehow, Mad Dog does not remember this. ?He claims to only remember the good. ?Seeing my cranky face at the end of this week managed to bring it all back into focus. ?Who knew being cranky could work so much in my favor?

I think I dodged a bullet. ?At least, I sure hope I did.

Square-Enix recently announced this week?that it will release the new Final Fantasy XIV: A Realm Reborn for the PC and PlayStation 3 console. Is Social Media Elitist?

You already know social media can help get you a job, but new research suggests that's much more likely to be the case for higher-level managerial jobs than it is for low-paying jobs.

Researchers at North Carolina State University show that informal social networks such as Facebook and LinkedIn play an important role when it comes to finding jobs in both the United States and Germany, but those networks are significantly more important for high-paying jobs in the United States, which may contribute to economic inequality, the researchers speculate.

The researchers looked at nationally representative survey data from the United States and Germany to compare the extent to which people find new jobs through "informal recruitment." Informal recruitment via social media occurs when a person who is not looking for a new job is approached with a job opportunity through social connections.

The study shows that, on average, informal recruitment is significantly more common in Germany, where approximately 40 percent of jobs are filled through informal recruitment, ?as opposed to approximately 27 percent of jobs in the United States.

However, the jobs people find through informal recruitment in the United States are much more likely to be high-wage managerial positions. Specifically, in the United States, the odds that a job will be filled via informal recruitment increase by 2 percent for every dollar of hourly wage that the job pays.

For example, the odds that jobs paying $40 per hour ($80,000 per year) will be filled through informal recruitment are about 66 percent better than the odds that a minimum-wage job ($7.25 per hour) will be filled through informal social media recruitment.

By comparison, the researchers found that wages in Germany did not appear to be linked to how workers found their jobs.

?The finding was surprising since in the United States a free market with minimal labor restrictions is believed to value merit over social connections, said Richard Benton, a Ph.D. candidate at NC State who co-authored the research.

?"Ultimately, this suggests that U.S. economic institutions offer greater rewards to sponsorship and nepotism than what we see elsewhere, which could help to explain why inequality is so extreme here," said Steve McDonald, an associate professor of sociology at NC State and lead author of the paper.

The paper was published online in the journal Social Forces. The paper was co-authored by David Warner of the University of Nebraska-Lincoln. The research was supported by NC State?s College of Humanities and Social Sciences.

(AP) ? People are inventing so many new ways to get high that lawmakers can't seem to keep up.

Over the past two years, the U.S. has seen a surge in the use of synthetic drugs made of legal chemicals that mimic the dangerous effects of cocaine, amphetamines and other illegal stimulants.

The drugs are often sold at small, independent stores in misleading packaging that suggests common household items like bath salts, incense and plant food. But the substances inside are powerful, mind-altering drugs that have been linked to bizarre and violent behavior across the country. Law enforcement officials refer to the drugs collectively as "bath salts," though they have nothing in common with the fragrant toiletries used to moisturize skin.

President Barack Obama signed a bill into law earlier this month that bans the sale, production and possession of more than two dozen of the most common bath salt drugs. But health professionals say lawmakers cannot keep pace with bath salt producers, who constantly adjust their chemical formulations to come up with new synthetic drugs that aren't covered by new laws. Experts who have studied the problem estimate there are more than 100 different bath salt chemicals in circulation.

"The moment you start to regulate one of them, they'll come out with a variant that sometimes is even more potent," said Dr. Nora Volkow, director of the National Institute on Drug Abuse.

There are no back alleys or crack houses in America's latest drug epidemic. The problem involves potent substances that amateur chemists make, package and sell in stores under brands like "Ivory Wave," ''Vanilla Sky" and "Bliss" for as little as $15. Emergencies related to the drugs have surged: The American Association of Poison Control Centers received more than 6,100 calls about bath salt drugs in 2011 ? up from just 304 the year before ? and more than 1,700 calls in the first half of 2012.

The problem for lawmakers is that it's difficult to crack down on the drugs. U.S. laws prohibit the sale or possession of all substances that mimic illegal drugs, but only if federal prosecutors can show that they are intended for human use. People who make bath salts and similar drugs work around this by printing "not for human consumption" on virtually every packet.

Barbara Carreno, a spokeswoman for the Drug Enforcement Agency, said the intended use for bath salts is clear.

"Everyone knows these are drugs to get high, including the sellers," she said.

Many states have banned some of the most common bath salts, which are typically sold by small businesses like convenience stores, tobacco shops and adult book stores. For instance, West Virginia legislators banned the bath salt drug MDPV last year, making it a misdemeanor to sell, buy or possess the synthetic drug. Conviction means up to six months in jail and a $1,000 fine.

Stephanie Mitchell, assistant manager of The Den, a tobacco and paraphernalia shop in Morgantown, W.Va., said the store hasn't sold bath salts in the six months that she's worked there. But strung-out users still come in and ask for them.

"They're pretty ... cracked out, I guess would be a good word," said Mitchell, 21, a student at West Virginia University. "They're just kind of not all there. They're kind of sketchy people."

Mitchell says she wouldn't sell bath salts even if she had them, "because it's horrible, and I could get in trouble for it."

Despite the bans, bath salts producers are constantly tweaking their recipes to come up with new drugs that aren't covered by local laws. In fact, Mark Ryan, director of the Louisiana Poison Center, says there are so many different drugs out there that it's almost impossible to know what people have ingested, or how long the effects will last.

"Cocaine is cocaine and meth is meth. We know what these things do," he said. "But with these new drugs, every time the chemist alters the chemical structure, all bets are off."

THE SPREAD

The most common bath salt drugs, like MDPV and mephedrone, were first developed in pharmaceutical research laboratories, though they were never approved for medical use. During the last decade they became popular as party drugs at European raves and dance clubs. As law enforcement began cracking down on the problem there, the drugs spread across the Atlantic Ocean.

Poison control centers in the U.S. began tracking use of the drugs in 2010. The majority of the early reports of drug use were clustered in Southern states like Louisiana, Tennessee and Kentucky. But the problem soon spread across the country.

The financial lure for small-time drugmakers is enticing. The drugs can be cheaply imported from China or India, and then easily packaged under local brands. For example, bath salts sold in Louisiana carry regional names like Hurricane Charlie or Bayou.

The widespread availability of the drugs in stores is equally alluring for drug users: they can get a cheap high similar to that of illegal drugs by walking to a corner store.

The most dangerous synthetic drugs are stimulants that affect levels of both dopamine and serotonin, brain chemicals that affect mood and perception. Users, who typically smoke or snort the powder-based drugs, may experience a surge in energy, fever and delusions of invincibility.

Use of these drugs has spread across the country with reports stretching from Maine to California. There are no official federal estimates on deaths connected with the drugs, many of which do not show up on typical drug tests. But police reports have implicated the drugs in several cases.

Packets of "Lady Bubbles" bath salts, for instance, were found on Sgt. David Franklyn Stewart last April after the solider shot and killed his wife and himself during a car chase with law enforcement near Olympia, Wash.

The chase began when Stewart sped past a police patrol car at 6 a.m. The police trooper pursued for 10 miles and reported seeing the driver raise a hand to his head, then heard a shot and saw the driver slump over. The next day police found the couple's 5-year-old son dead in their home; he had been suffocated with a plastic bag at least 24 hours earlier.

Another death involving bath salts played out in Covington, La. Police reported that Dickie Sanders, 21, shot himself in the head Nov. 11, 2010 while his parents were asleep.

His father, Dr. Richard Sanders, said his son had snorted "Cloud 9" bath salts and endured three days of intermittent delirium, at one point attempting to cut his own throat. As he continued to have visions, his physician father tried to calm him. But the elder Sanders said that as he slept, his son went into another room and shot himself.

WHAT'S AHEAD

Hospital emergency rooms, doctors and law enforcement agencies across the country have struggled to control bath salt drug users who often are feverish and paranoid that they are being attacked. Doctors say users often turn up naked because bath salts raise their body temperature so much that they strip off their clothing.

Cookeville Regional Medical Center in Tennessee has treated 160 people suspected of taking bath salts since 2010. Dr. Sullivan Smith, who works there, said people on the drugs become combative, and it can take four or five health professionals to subdue them. In some cases, he said, doctors have to use prescription sedatives that are typically reserved for surgery.

Smith recalls one man who had been running for more than 24 hours because he believed the devil was chasing him with an ax. By the time police brought him to the hospital, he was dehydrated and covered in blood from running through thorny underbrush.

"We're seeing extreme agitation, hallucinations that are very vivid, paranoia and some really violent behavior, so it's a real crisis for us," Smith said. "We sedate the living daylights out of them. And we're talking doses on the order of 10 or 20 times what you would give for a painful procedure."

To control the spread of the problem, the Drug Enforcement Agency issued a temporary ban in October on three of the most common drugs ? mephedrone, methylone and MDPV. That ban became permanent under the bill signed by Obama on July 10.

Under the law, anyone convicted of selling, making or possessing 28 synthetic drugs, including bath salts, will face penalties similar to those for dealing traditional drugs like cocaine and heroin.

Those on the front lines say the legislation is a good start. But they don't expect new laws to dramatically curb use of bath salts in the near term.

"The problem is these drugs are changing and I'm sure they're going to find some that are a little bit different chemically so they don't fall under the law," said Dr. Smith, the Tennessee doctor. "Is it adequate to name five or 10 or even 20? The answer is no, they're changing too fast."

Canada's Rogers Communications Sees Q2 Profit Dip on Stronger ...

TORONTO ? Hit by increased competition in wireless, Canadian cable and phone giant Rogers Communications on Tuesday reported lower second quarter earnings and flat overall revenue.

Toronto-based Rogers saw earnings for the three months to June 30 come in at $400 million, down 2.4 percent from a year-earlier profit of $410 million, on virtually unchanged revenue of $3.11 billion.

The wireless phone division, which posted revenue up 1 percent to $1.76 billion, added fewer postpaid subscribers during the latest quarter, compared to 2011 levels.

And the monthly bill for subscribers fell by $1.61 to $68.46 on lower voice revenue.

At the same time, margins for smartphone use beat analyst expectations.

"Our revenue and adjusted operating profit growth in the second quarter was highlighted by strong postpaid wireless smartphone sales and customer retention metrics, as well as exceptionally strong margins in both our wireless and cable businesses," Rogers Communications president and CEO Nadir Mohamed said in a release.

The cable TV division saw revenue rise 1 percent to $843 million, while the media division, comprising radio and TV channels, saw revenue in a soft ad market rise 1 percent to $440 million owing in part to higher subscriber fees for TV sport channels.

Will trial shed light on motive in Aurora killings?

Legal expert Linda Kenney Baden and psychiatrist Dr. Gail Saltz discuss suspected gunman James Holmes' bizarre court appearance and what his possible mental instability means to the efforts to try him in court.

While relatives of the victims of last week?s movie theater massacre in Aurora, Colo. ? and the public at large ? are understandably fixated on why the crime was committed, the criminal justice system to a large extent will ignore that question in determining guilt and punishment.?

It appears that the alleged shooter, 24-year-old James Eagan Holmes,?acted alone, so there apparently is no conspiracy or anyone else directly to blame. Nor is there any indication that this was the act of a terrorist?organization or individual attempting to advance a political agenda of some sort.?The crime allegedly was committed by a single human being who explained himself to police as being a character from?the Batman comics ? the Joker.??

But in deciding whether?a person should be punished ? and how much ? the law will inquire into a very limited set of questions.?


The first is guilt. With a multitude of witnesses inside the theater able to testify about the black body armor worn by the gunman and Holmes arrested just outside the theater moments afterward wearing an identical ensemble, defense attorneys appear to have little chance of persuading a jury that their client did not pull the triggers of the weapons ? all of which he had legally purchased ? used in the crime. And the fact that he apparently booby-trapped his apartment immediately before the slaughter, with the apparent intent of creating a diversion, only adds to the evidence against him.?

If Holmes is convicted in connection with the crime, an insanity?defense will almost certainly be contemplated.?But?the legal question raised by an insanity defense is relatively straightforward: Did the defendant understand the difference between right and wrong??

Past aids Aurora response, but were warnings unheeded?

John Hinckley, Jr., escaped criminal punishment when?he attempted to assassinate President?Ronald Reagan?to impress the actress Jodie Foster, but?in the wake of his successful insanity defense,?legislatures made it considerably more difficult for defendants to?prevail on?the grounds of mental incapacity. Under the law that existed at the time, defendants were not legally responsible even if they knew an action was wrong if they could show they were unable to resist the impulse to commit the act.?After Hinckley's case, a number of states, including Colorado, amended their laws to permit a successful insanity defense only if the defendant did not know the difference between right and wrong. The upshot of this more stringent requirement is that defendants rarely prevail when they claim insanity. ?

James Holmes, the suspected gunman in the tragic Aurora movie theatre massacre was seen nodding off, glaring and staring blankly at a court hearing, leading many to speculate about an insanity defense. NBC's Kate Snow reports.

So, if Holmes? attorneys pursue an insanity defense, the jury will be asked only one question: Did he know it was wrong to try to take the lives of scores of people???If the answer to that question is ?yes,? then the question becomes: What degree of homicide did he commit.?To determine this, the jurors must decide whether he intentionally and deliberately killed his victims ? first-degree murder ? or whether he merely knowingly or recklessly killed them ? second-degree murder.?The degree of planning allegedly involved in this case, however, leaves no doubt that Holmes intended the results.?

There will then be a final question about punishment. Colorado has the death penalty, though death sentences are quite rare in the state and there has only been one execution in 30 years. Nevertheless, there is the possibility of a death sentence in this case.? Under Colorado law a jury may return a death sentence if the defendant killed more than one human being in a single episode.? Almost certainly he did.?

In a capital case ??and it seems likely this will be a capital case ??the defense is permitted to present anything in mitigation. That means that the defense may attempt to explain why the defendant attempted to take the lives of scores of innocent?persons,?but it is certainly not required to do so. It can focus on any aspect of?his life in an effort to save it. And the prosecution only has to demonstrate that the mass killing occurred to obtain a death?sentence. Nothing requires either side to present evidence of what motivated this man before incarcerating him or even executing him.?

As a result,?any trial is likely to leave victims, and their families, with?nearly as many unanswered questions as they have now.? ?
